TERMS AND CONDITIONS OF SALE (CGV)

PREAMBLE

The present general conditions of sale govern the contractual relations between :
The Company "Babusia L'âme slave" represented by Virginie Hoffmann 51 rue du général Devink 59270 Godewaersvelde (SIRET 78887092100038), hereinafter referred to as "the Seller".
And, any individual or legal entity, hereinafter referred to as "the Buyer" or "the Customer" who places an order on https://www.babusia.com, hereinafter referred to as "the Website".

These general terms and conditions of sale apply to all orders placed by the Buyer on the http://www.babusia.com website.

Article 1 - Scope of application

You declare that you are at least 18 years of age and have the legal capacity to place an order on the site. Any order implies full acceptance of these terms and conditions of sale, prices and descriptions of products offered for sale.
"Babusia - L'âme slave" reserves the right to modify all or part of these terms and conditions of sale without prior notice.

Article 2 - Products sold on the Website

The products governed by the present terms and conditions are those which appear on the Vendor's Internet Site and which are indicated as sold and dispatched by the Vendor. They are offered while stocks last. The products are described and presented as accurately as possible.

However, the Vendor cannot be held responsible for any errors or omissions in this presentation. Product photographs are not contractual.

Article 3 - Prices

Prices are indicated in euros, all taxes included. They do not include delivery charges, which are invoiced in addition and indicated before the order is validated.
The Buyer is informed that the final validation of his/her order requires immediate payment on the Website or by cheque.
The Vendor reserves the right to modify its prices at any time, but undertakes to apply the prices in force at the time of the order, subject to availability on that date.

Article 4 - Delivery charges

The seller delivers in France as well as in the rest of the world.
Shipping costs are the costs of preparation, packaging and postage for sending the order.
The cost of postage by lettre suivie is €3 for France and €6 for other countries. The cost of postage by colissimo is €5 for France and €14 for Europe. For rates outside the European Union, please send an e-mail to contact@babusia.com.
Shipping is free for orders over €120 in France and €160 for all other countries.

Article 5 - Delivery times

Delivery times are calculated from the date of receipt of the order amount in the Vendor's bank account.
For deliveries, the delivery time is 1 to 2 working days from the day following that on which payment for the order has been received in the Vendor's bank account for one-off creations. Items made to order (which you can find in the "Soft prices" tab) take between 2 and 5 days.

Products ordered will be sent to the address you indicate during the ordering process.
"Babusia" is not responsible for delays in delivery caused by the indication of an erroneous or incomplete address by you.
"Babusia" also declines all responsibility for delays in delivery caused by the absence of the recipient of the parcel or his failure to collect it within the time limit set for this purpose.
If an order is returned for the reasons mentioned above, you will have to pay the costs of a new shipment.

Article 6 - Customs duties
If you live outside the European Economic Area, customs duties apply upon receipt of your parcel. Prices do not include any customs duties, taxes, fees or other charges for the import of goods due by the purchaser or recipient upon receipt of the order.
"Babusia - L'âme slave" is not obliged to check and/or inform the purchaser of these. To find out about them, "Babusia - L'âme slave" recommends the buyer to contact the competent authorities of his department, territory or country.

Article 7 - The order

The Buyer adds to his/her basket the products he/she wishes to order by clicking on the "order" button.
To order a product, the buyer must click on the "add to basket" button.

Ordering:

Any order placed on the Website implies acceptance of the prices and descriptions of the products you have placed in the basket.
In certain cases, notably non-payment, incorrect address or other problem with the Buyer's account, the Vendor reserves the right to block the Buyer's order until the problem has been resolved.
For any questions relating to the tracking of an order, the Buyer should contact the Vendor by e-mail at the following address: contact@babusia.com.

We will acknowledge receipt of your order by an order confirmation e-mail sent automatically to the address you have provided.

Any anomaly concerning the order (missing item compared with the delivery note, damaged parcel, defective item) must be notified within 2 days of delivery. After this period, the buyer cannot claim an exchange or refund.

Article 8 - Payment methods

During the ordering process, you will be offered the following payment methods to pay for your purchases:
- credit card (Visa, MasterCard) Stripe,
- payPal secure payment system,
- bank transfer,
- check
Regardless of the method of payment you choose, all payments will be considered final only after full and effective collection.
The invoice will be sent to you exclusively in electronic form for France and in paper format for other countries.

The Vendor reserves the right to suspend all order processing and deliveries in the event of refusal to authorize payment by officially accredited bodies or in the event of non-payment.
In particular, the Vendor reserves the right to refuse to make a delivery or to honour an order from a Buyer who has not paid in full or in part for a previous order, or with whom a payment dispute is in progress.

Article 9 - Delivery terms

Delivery is only made after confirmation of payment by the Seller's bank, and delivery times only begin to run from this date.
Products ordered are delivered to the address indicated by the Buyer on the order form. Delivery is made by "Lettre Suivie", i.e. directly to your letterbox.

Article 10 - Right of withdrawal

In accordance with article L.121-20 of the French Consumer Code, our consumer customers have a period of fourteen clear days from receipt of the goods to exercise their right of withdrawal without having to justify their decision or pay any penalties, except for the cost of returning the goods. There is no right of withdrawal for products made to customer specifications or clearly personalized.
For all returns, please send an e-mail to contact@babusia.com. On receipt of this e-mail, the seller will inform you of the procedure to follow: return the goods, at your expense, to the following address: Virginie Hoffmann - babusia L'âme slave 51 rue du général Devinck 59270 Godewaersvelde.
Goods must be returned in their original packaging and in perfect condition so that they can be sold as new. For optimal management, please enclose the delivery note with the returned goods.
If you exercise your right of withdrawal within the stipulated period, the price of the products returned will be reimbursed in full, using the means of payment you chose for your order, as soon as possible and no later than thirty days following the date on which the right of withdrawal was exercised.

Article 11 - Reservation of ownership

The Vendor retains ownership of the products until the price has been paid in full and deposited at the post office. The risks relating to delivery of the products ordered are transferred to the Buyer once delivery has been made.

Article 12 - Intellectual property

"Babusia - L'âme slave" is a registered trademark with the INPI. All models, concepts, texts and photos are the exclusive property of the designer. They benefit from both copyright and trademark protection.
In addition, every "Babusia - The Slavic Soul" design is registered with IPOCAMP for international legal protection against copying.
The total or partial reproduction of any of these elements, on any medium whatsoever and for any reason whatsoever, without the prior and express consent of "Babusia - L'âme slave" is strictly forbidden and may result in legal proceedings. The same applies to the use of photos without the creator's consent.
