PREAMBLE
These general terms and conditions of sale govern the contractual relationship between:

hereinafter referred to as “the Seller”,
and any natural or legal person making a purchase on the website
https://www.babusia.com, hereinafter referred to as “the Buyer” or “the Customer”.
Any order placed on the Website implies full and unconditional acceptance of these general terms and conditions of sale.
Article 1 - Scope
These general terms and conditions of sale apply to all orders placed on the website www.babusia.com.
By placing an order, the Buyer declares:
- to be at least 18 years of age
- having the legal capacity to enter into a contract
The Seller reserves the right to amend these general terms and conditions of sale at any time. The applicable terms and conditions are those in force at the time of the order.

Article 2 – Products
The products offered for sale are those displayed on the website www.babusia.com.
Babusia creations are handcrafted jewellery made from glass beads and various materials.
As each piece is handcrafted, slight variations may occur.
Products are available whilst stocks last.
Descriptions and photographs are produced with the utmost care. However, they are provided for information purposes only and are not contractually binding.
Article 3 – Prices
Product prices are quoted in euros, inclusive of all taxes (VAT included).
Delivery charges are not included in the product prices and are shown to the Customer before the order is confirmed.
The Seller reserves the right to change its prices at any time.
Products are invoiced on the basis of the price list in force at the time the order is confirmed.
Confirmation of the order implies immediate payment.
Article 4 - Delivery charges
The Seller delivers within France and internationally.
Delivery charges include the costs of preparation, packaging and dispatch.
Shipping costs amount to €3.50.
Delivery is free:
- for all orders of €120 or more within France
- for all orders of €200 or more internationally
Shipping methods:
Jewellery under 3 cm: sent as a tracked letter via La Poste. A tracking number is provided after dispatch.
Jewellery larger than 3 cm (bracelets, etc.): dispatched via Colissimo.
Article 5 – Delivery times
Delivery times begin from the date of payment confirmation.
This is generally 1 to 3 working days.
Made-to-order items may require additional time.
Shipments are made from Tuesday to Friday.
Products are sent to the address provided by the Customer at the time of ordering.
The Seller shall not be held liable:
- an incorrect address provided by the Customer
- the recipient’s absence
- the parcel not being collected within the specified time limit
If the parcel is returned for these reasons, the costs of reshipment shall be borne by the Customer.
Article 6 – Customs duties
For orders delivered outside the European Union, customs duties or taxes may be charged upon receipt of the parcel.
Any such charges are the responsibility of the Customer.
The Seller cannot be held liable for these charges and advises the Buyer to seek information from the relevant authorities in their country.
Article 7 – Order
Any order placed on the website implies acceptance of the prices and descriptions of the products in the basket.
The Seller reserves the right to suspend or cancel any order in the event of:
- a payment issue
- an incorrect address
- or a previous dispute with the Customer
A confirmation email is sent automatically to the address provided at the time of ordering.
Any issues (missing items, damaged parcels, faulty products) must be reported within 48 hours of receipt.
Article 8 – Payment methods
Payments can be made by:
- credit card (Visa, Mastercard, etc.)
- PayPal
and any other method offered via the Stripe platform
It is also possible to pay in cash when collecting your order in Godewaersvelde.
The order is only considered valid once payment has been received in full.
The Seller reserves the right to refuse any order in the event of a payment dispute.
Article 9 – Delivery
Delivery is made to the address provided at the time of ordering.
Shipments are made via the Post Office as:
- Tracked Letter
- Colissimo
Article 10 – Right of withdrawal
In accordance with the Consumer Code, the Customer has a period of 14 days from receipt of the product to exercise their right of withdrawal.
Return costs are the responsibility of the Customer.
Personalised products or those made to order are not subject to the right of withdrawal.
Items must be returned:
- in their original packaging
- in perfect condition so that they can be resold

Once the product has been received and checked, a refund will be issued via the payment method used when placing the order.
Article 11 – Retention of title
The products remain the property of the Seller until full payment of the order has been received.
The risks associated with transport are transferred to the Customer upon delivery.
Article 12 – Intellectual Property
The Babusia – L’âme slave brand is a registered trademark.
All elements featured on the website www.babusia.com, in particular:
- jewellery creations and designs
- motifs and representations (female figures, dolls, floral motifs, visual compositions)
- texts
- photographs
- logos
- the graphic identity
are the exclusive property of the designer.
These elements are protected by copyright, trade mark law and intellectual property law.
Babusia creations, handmade from glass beads, are the result of original artistic design.
Any reproduction, imitation, adaptation or use, in whole or in part, without the designer’s prior written consent is strictly prohibited.
This includes, in particular:
the reproduction of jewellery designs
the use of distinctive motifs
the reproduction of photographs
any commercial exploitation of the creations or their visual concept.
Any infringement of these rights may be subject to civil and criminal proceedings, in accordance with the provisions of the Intellectual Property Code.

In accordance with the provisions of the Consumer Code concerning the amicable settlement of disputes, Babusia is a member of the following mediation service:

Following a prior written request to Babusia, the consumer may refer any dispute to the mediator.
